Terms of Service

1. Introduction

Welcome to Aioomi ("we", "our", or "us"). The Service is owned and operated by MySelf Yevhen Shcherbynskyi, based in Warsaw, Poland. These Terms of Service ("Terms") govern your access to and use of the Aioomi platform, website at aioomi.com, APIs, embeddable widgets, and any related services (collectively, the "Service").

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

2. Definitions

  • "Platform" means the Aioomi web application, dashboard, APIs, and embeddable chat widget.
  • "Agent" means an AI-powered chatbot created and configured by a User on the Platform.
  • "User" means any individual or entity that registers for and uses the Service.
  • "End User" means any individual who interacts with an Agent through the embeddable widget or other interface.
  • "Knowledge Base" means a collection of documents uploaded by a User for retrieval-augmented generation (RAG).
  • "Content" means any data, text, documents, or other materials uploaded to or generated by the Service.

3. Account Terms

To use the Service, you must create an account using a valid email address and password, or by authenticating through Google OAuth. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.

You must be at least 18 years of age to use the Service. By creating an account, you represent that you meet this requirement.

You must provide accurate and complete information when creating your account and keep your account information up to date. You may not use another person's account without permission.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in compliance with these Terms. You shall not:

  • Use the Service to generate, distribute, or facilitate illegal, harmful, fraudulent, or deceptive content.
  • Configure Agents to impersonate real individuals or organizations without authorization.
  • Upload malicious, infringing, or unlawful material to Knowledge Bases.
  • Attempt to reverse-engineer, decompile, or extract the source code of the Service.
  • Interfere with or disrupt the integrity or performance of the Service or its infrastructure.
  • Use automated means to access the Service in a manner that exceeds reasonable request volumes or constitutes abuse.
  • Resell access to the Service without prior written consent from Aioomi.

5. Intellectual Property

The Service, including its design, code, features, and documentation, is owned by Aioomi and protected by intellectual property laws. These Terms do not grant you any right, title, or interest in the Service except for the limited right to use it as described herein.

You retain ownership of all Content you upload to the Service, including documents in your Knowledge Bases and Agent configurations. By uploading Content, you grant Aioomi a limited license to process, store, and transmit that Content solely for the purpose of providing the Service.

AI-generated responses produced by your Agents are provided on an "as-is" basis. You are responsible for reviewing and validating AI-generated content before relying on it or presenting it to End Users.

6. Data & Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.

You acknowledge that messages sent through Agents are processed by third-party AI providers (currently OpenAI) and are subject to their respective terms and privacy policies. You are responsible for informing your End Users of this data processing.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AIOOMI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

Aioomi does not guarantee the accuracy, completeness, or reliability of AI-generated responses. The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied.

Our total aggregate liability to you for any claims arising from or related to the Service shall not exceed the amount you paid to Aioomi in the twelve (12) months preceding the claim.

8. Termination

You may terminate your account at any time by contacting support at aioomi.help@gmail.com. Upon termination, your right to use the Service ceases immediately.

We may suspend or terminate your account if we reasonably believe you have violated these Terms, or if required by law. We will make reasonable efforts to notify you before termination unless doing so would be impractical or legally prohibited.

Upon termination, we will delete your data in accordance with our Privacy Policy and applicable data retention requirements.

9. Changes to Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or by posting a notice on the Service at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
